Every rental home should be safe, secure, and liveable. In Victoria and New South Wales, landlords and rental providers are legally required to meet minimum standards before advertising or leasing a property. The standards cover key areas from bathroom facilities to ventilation, with Victoria enforcing a more comprehensive 15-category checklist and NSW outlining seven core requirements. Victoria: at a glance

  • Overall: 15 mandatory categories that must be checked before a tenant moves in.
  • Quick-hitting requirements:
    • Bathroom: sink, shower or bath, hot and cold water; shower head must be 3-star water efficiency (1–2 star acceptable if 3-star isn’t feasible).
    • Electrical safety: modern switchboards, circuit breakers, electrical safety switches; electrician inspection required.
    • Heating: fixed, working heater in the main living area; from March 2023, energy-efficient upgrades are required.
    • Energy-efficient heaters can include: non-ducted AC/heat pump (2-star+), gas space heater (2-star+), ducted or hydronic systems, or a domestic solid-fuel appliance.
    • Kitchen: functional cooking area, hot/cold water sink, two+ burner stovetop; oven in good working order if present.
    • Laundry: access to hot/cold water if a laundry exists.
    • Lighting and ventilation: adequate lighting in all rooms; natural light by day; artificial light at night.
    • Security: external doors with functional deadlocks or keyed locks from outside; internal access without a key.
    • Mould, damp, structural soundness, ventilation, and weatherproofing: rooms must be free of mould and damp and the property must be structurally sound.
    • Toilets: separate, in good working order, connected to sewerage/septic.
    • Vermin-proof bins: provision of vermin-proof rubbish and recycling bins meeting council standards.
    • Windows and coverings: secure, operable windows with latches; living/sleeping areas have curtains or blinds; corded coverings have anchors to prevent loose cords.
  • If standards aren’t met:
    • It’s a criminal offence to let a new renter move in without meeting minimum standards under the Residential Tenancies Act 1997.
    • Penalties: individuals up to ~$11,800; companies up to ~$59,000.
    • Urgent repairs must be made promptly. If not, renters may arrange urgent repairs (up to $2,500) and seek reimbursement.
    • Rent may be held in a VCAT rent account while repairs are organised; processes exist for reclaiming rent.
